Free Movement of Workers and its Impact on Sport (Football)

Abstract:

Anotace v českém jazyce: Ve své práci se věnuji svobodě volného pohybu pracovníků v Evropské unii a jejímu dopadu na sport (fotbal). Práce je složena z osmi samostatných kapitol. V první kapitole se věnuji, problémům fotbalu v České republice pojmenuji základní problémy na, které jsem v průběhu studia materiálů narazila. Jedním z problémů je nedostatečná ochrana osobních údajů, které shromažďuje Fotbalová asociace České republiky. Mezi další problémy patří smluvní postavení profesionálních fotbalistů především absence pracovních smluv. Sporné je také postavení dětí a mládeže v profesionálním a amatérském fotbale. Pokud se děti rozhodnou změnit klub je nutné zaplatit tabulkové odstupné. Ve druhé kapitole se věnuji sportu v právu Evropské unie. Analyzuji volný pohyb pracovníků v rámci Evropské unie. Dále se zabývám výjimkami, které povolují určitá omezení volného pohybu osob. Uvádím zde i příklady diskriminace na základě státní příslušnosti ve sportu. Na závěr druhé kapitoly se věnuji ochraně hospodářské soutěže v Evropské unii a povoleným výjimkám. Třetí kapitola obsahuje podrobnou strukturu fotbalových asociací. Na vrcholu stojí Mezinárodní fotbalová asociace FIFA. Další asociace se dělí, podle kontinentů pro Evropu je to Evropská fotbalová asociace UEFA. V jednotlivých státech jsou na vrcholu národní fotbalové asociace, které sdružují jednotlivé kluby. Ve čtvrté kapitole podrobně rozebírám judikát v kauze Bosman. Pátá kapitola se zabývá tím, jaký vliv měl případ Bosman na budoucnost fotbalu v Evropě a vzniku nových přestupových pravidel. Na závěr páté kapitoly uvádím další soudní rozhodnutí Evropského Soudního dvora případ Olivier Bernard. Šestá kapitola zkoumá, různá stanoviska Evropské unie ke sportu popisuji obsah Bílé knihy o sportu a obsah studie ekonomických a právních aspektů týkajících se přestupů hráčů. Na závěr této kapitoly popisuji takzvané Finanční fair play, které schválila UEFA. V sedmé kapitole se věnuji účinkům práva Evropské unie vůči státním příslušníkům ze třetích států a jako příklad uvádím případ Simuntenkov. Osmá kapitola je, závěrem mé práce zde shrnuji základní problémy a navrhuji jejich řešení.

Abstract:

Annotation in English: In my wrok I deal with freedom of transfer of employees in European Union and its effect on sport (football). The work consists of eight independent chapters. The first chapter focuses on football in the Czech Republic and I will name he basic problems, which I have come across during my research. One of the problems is inadequate protection of personal data, wich is collected by the Football Association of the Czech Republic. Another problem is contractual position of profesional football players, mainly the absence of employment contracts. The position of children and youth in profesional and amateur football is also contraversial. If children decide too change their club, a compensation must be paid. The second chapter is focused on sports and European Union law. I analyse the free movement of labour within the Europan Union. I deal with exeptions that permit certain restrictions of the free movement of persons. I mention examples of discrimination in sports based on nationality. And at the end of the second chapter I deal with protection of competition in the Europan Union and with permitted exceptions. The third chapter contains of detailed structure of the football associations. The most important is the international football association FIFA. Other associatinos are divided according to the continents (Europan soccer association UEFA for Europe) and then there are National football associaations, which are the governing bodies of football in each country. In the fourth part I will introduce the Bosman ruling. The fifth chapter deals wil the impact of Bosman case on the future of football in Europe. It also deals with the new rules concerning the transfers football players. At the end of the fifth chapter I mention another judicial decisions of the European Court of Justice, which is Olivier Bernard case. The sixth chapter is focudes on the various views of the European Union on sports. It describes the content of the Wthe Paper on Sport and the content of Study on the Economic and Legal aspects of transfers of players. In the end of this part, I will describe „financial fair play“ approved by UEFA. The seventh chapter is devoted to the effects of Europan Union law towards third- country nationals. As an example I introduce the Simuntenkov case. The eighth chapter is the conclusion of my work where I summarize the problems and propose.
