The Principle of Precedent in English and American Law

Abstract:

Práce se zabývá precedentem nejen jako významným institutem common law, ale též jako fenoménem angloamerické právní kultury. Vychází jak z prací renomovaných anglických právních teoretiků (Rupert Cross, Neil Duxbury aj.), tak i právních teoretiků domácích (Viktor Knapp, Michal Bobek, Zdeněk Kühn, Jan Kuklík), kteří jsou si vědomi jak specifičnosti angloamerické a evropské kontinentální právní kultury, tak i jistých konvergentních tendencí mezi soudním precedentem a judikaturou. První kapitola vymezuje základní charakteristiku anglického práva, s určitými zvláštnostmi práva amerického. Druhá kapitola pojednává o historii precedentu jednak ve vztahu k law reporting, jednak k utváření doktríny precedentu. Třetí a čtvrtá kapitola se zaobírají teoretickým rozborem precedentu nejprve z hlediska pozitivního práva, tj. jde na tomto místě především o strukturu precedentu, o vymezení jeho autority a závaznosti mj. ve vztahu k hierarchii anglických soudů a k soudní interpretaci zákonného práva. Následuje teoretické ospravedlnění precedentu (konsekvencialistické, deontologické aj.) a řešení otázky, proč následovat precedent. V této souvislosti jsou také zmíněny některé pojmy (otevřená struktura, vylučující důvody) významných anglických právních filozofů H.L.A. Harta a Josepha Raze. Výklad uzavírá kapitola pojednávající o tištěných i elektronických zdrojích, kde může student práv precedenty nalézt; zmíněna je i metoda výuky práva skrze precedenty na amerických školách.

Abstract:

This master's thesis deals with precedent viewed not only as significant device of common law, but also as phenomenon of the Anglo-American culture of law. It is based both on writings of renowned English jurists (Rupert Cross, Neil Duxbury and others), and on writings of Czech jurists (Viktor Knapp, Michal Bobek, Zdeněk Kühn, Jan Kuklík), who are first of all well aware of specific nature of Anglo-American and European continental culture of law respectively, but also they don´t neglect certain convergent tendencies between precedent and the practice of the courts in Europe (la jurisprudence in French). The first chapter sets out the basic characteristic of English law, alongside certain peculiarities of American law. The second chapter deals with history of precedent; first in relation to law reporting, and second in relation to evolution of the doctrine of precedent. The third and fourth chapters cover theoretical analysis, first on the level of positive law, that is pertaining above all to the structure of precedent, to defining its authority and binding effect in relation to the hierarchy of English courts and to the judicial interpretation of statute law. Next follows theoretical justification of the precedent (consequentialist, deontological, etc.)and solution of the question why precedent should be followed. In this context some terms have been mentioned (open structure, exclusionary reasons, etc.)that had been set forth by remarkable law philosophers H.L.A. Hart and Joseph Raz. The text has been concluded by chapter dealing with paper and electronic sources, where college law student can find the precedents; also the case method in teaching law by means of precedents in American law schools has been mentioned.
