Execution of imprisonment in Czech prisons

Abstract:

Poté, co byl na našem území zrušen trest smrti, je trest odnětí svobody tím nejpřísnějším trestem, který může být uložen. Představuje nejcitelnější zásah do života jedince, který je v demokratickém právním státě možný. Tato diplomová práce se v první řadě zabývá základním právním rámcem výkonu trestu odnětí svobody v ČR i Evropě. Dále popisuje základní statistická data výkonu trestu odnětí svobody. Pro snadnější uchopení tématu je zařazena kapitola zabývající se praxí výkonu trestu z hlediska systému vězeňství, vnitřního řádu věznic a běžného denního režimu ve věznicích. V závěrečné části se zaměřuji na aktuální problémy českého vězeňství. Na tuto problematiku je zaměřena i praktická část práce. Prostřednictvím rozhovoru ukazuji, jak respondenti z řad vězeňské služby i z řad bývalých odsouzených vnímají dané problémy a rozumí jim.

Abstract:

After the death penalty was abolished in our territory, imprisonment is the most severe punishment that can be imposed. It represents the most sensitive intervention in the life of an individual that is possible in a democratic legal state. This diploma thesis primarily deals with the basic legal framework for the execution of prison sentences in the Czech Republic and Europe. It also describes the basic statistical data of the execution of the prison sentence. For an easier understanding of the topic, a chapter is included dealing with the practice of serving the sentence from the point of view of the organization of prisons, the internal rules of prisons and the normal daily regime in prisons. In the final part, I focus on the current problems of the Czech prison system. The practical part of the work is also focused on this issue. Through an interview, I show how respondents from the prison service and former convicts understand and perceive the given problems.
