Administrative Procedures in the Field of Real Estate

Abstract:

Tato diplomová práce se zabývá rozborem právní úpravy správního řízení na úseku katastru nemovitostí. Její stěžejní částí je potom analýza řízení o povolení vkladu a řízení o opravě chyby v katastrálním operátu včetně jejich vztahu ke správnímu řádu. V práci je v rámci problematiky základních zásad vedení katastru vyčleněn prostor též očekávanému znovuzavedení zásady superficies solo cedit do právního řádu České republiky. Závěr práce je zaměřen na změny v současné právní úpravě a jejich dopad na praxi katastrálních úřadů, shrnuje poznatky, které ze zpracování vyplynuly a uvádí náměty de lege ferenda.

Abstract:

This thesis deals with the analysis of legal regulation of administrative procedures in the field of real estate. Its key part is dedicated to the analysis of the administrative procedure of deposit in the land registry and the procedure of correcting errors in the land register data, including their relation to rules of administrative procedure. In the area of basic land management principles, the thesis also includes comment on the expected reintroduction of the principle superficies solo cedit in the Czech law. The conclusion focuses on current legislation changes and their impact on the practice of cadastral offices. It also summarizes the findings that emerged from the elaboration and gives suggestions on legal aspects.
