Legal Control of Public Administration, the Role of Administrative and Constitutional Judiciary in the System of Public Administration Control

Abstract:

Předkládaná práce na téma „ Soudní kontrola veřejné správy, úloha správního a ústavního soudnictví v systému kontroly veřejné správy“ je věnována jednak reformě správního soudnictví na území České republiky, ke které dochází s účinností zákona č. 150/2002 Sb. tedy soudního řádu správního, a dále pak ochraně veřejných subjektivních práv občanů současnou praxí správního soudnictví. Každý z nás, jenž jsme občany České republiky, žijeme ve společnosti, zorganizované ve stát. Tento stát disponuje státní neboli veřejnou mocí, za pomocí které vykonává veřejnou správu. Při výkonu této veřejné správy rozhoduje prostřednictvím svých státních orgánů o právech a povinnostech občanů, přičemž stojí vůči nim v nadřazeném postavení. Stát, ve kterém žijeme je státem právní a demokratickým, je tedy na místě, aby tyto zásahy státu do práv občanů, které mnohdy v nemalé míře životy lidí ovlivňují, byly pod určitou kontrolou. Kontrolou zjišťujeme, zda-li kontrolovaný stav odpovídá stavu, který býti měl nebo má. Ze zjištěných skutečností se pak následně vyvozují závěry a stanovují příslušná opatření. Soudní kontrola veřejné správy, na kterou je v této bakalářské práci zaměřena pozornost především, je jedním z hlavních způsobů, jak se lze svých veřejných subjektivních práv domoci. Soudní ochrana těchto práv spadá do kompetencí tzv. správního soudnictví, které v České republice vykonávají krajské soudy a Nejvyšší správní soud. Nejvyšší správní soud dlouhá léta v české justici nepůsobil, ačkoli byl zakotven v Ústavě ČR. Novelou správního soudnictví ´činnou počátkem roku 2003 však opět tato instituce začíná působit. Jejím úkolem je především sjednocování rozhodování krajských soudů rozhodujících ve správním soudnictví. Rozhoduje o kasačních stížnostech proti rozhodnutím krajských soudů a v další věcech, které stanoví zákon. Jeho role je v současné době nezastupitelná a jen s těží si lze nyní českou justici bez Nejvyššího správního soudu představit. Pakliže jsou orgánem veřejné správy porušena práva a svobody ústavními zákony zaručená, přísluší kontrola veřejné správy Ústavnímu soudu ČR. Tento nepatří do sestavy soudů v České republice. Není zde od toho, aby vykonával jakby další soudní instanci nebo stupeň. Zabývá se žalobami týkajících se porušení základních a práv a svobod zaručených ústavními zákony. Přezkoumává také právní předpisy, když je tato kompetence v Ústavě ČR připisována Nejvyššímu správnímu soudu.

Abstract:

The presented thesis „ The justice control of public service. The task of administrative and constitutional justice in the system of control of public service“ deals at first with reform of the Czech administrative law which started by effecting of the act no. 150/2002 Coll. - Code of Administrative Justice, and on the other side with the protection of the public subjective rights of the people by current practise of administrartive jurisdiction. Each of us we are the citizens of the Czech republic, we live in the community which is organized into the state. This state has the public power which is executed by public service. State administration through the state authorities decides about the rights and duties of the citizens whithin the framework of its execution. This administrative state is standing over the people in superior position. We live in law and democratic state, so it´s necessary to have these state interventions under control because these state intrusions influence citizens´ lifes. We discover whether checked state agrees with the state which would have been or which is to be. Afterwards from the proven information we subsequently make decisions and set appropriate steps. The main point of the thesis is judicial control of public service which is one of the main way how to obtain own subjective public rights. Judicial protection of the rights in the Czech republic is under control of administrative justice which is performed by regional courts and The supreme court of the Czech republic. The supreme administrative court didn´t work in czech justice system for many years in spite of the fact that it had been implemented in the constitution of the Czech republic. The court came again back to the scene at the beginning of 2003 on the basis of the amendment of administrative justice law. It´s main goal is to unify the decisional practise of regional courts in the framework of administrative justice. The supreme administrative court hears cassational complaints against final decisions of regional courts and other law determined matters. It´s current role is hardly substitutable and it´s difficult to imagine czech justice without the supreme administrative court. If the constitutional rights or freedoms are broken by administrative authority a solution of the case is belonged to The constitutional court of the Czech republic. It is not involved in the court system of the Czech republic. This court is not to perform duties of another level or instance of justice. It is concerned with complaints againts the elementary and natural rights which are quaranteed by constitutional laws. Further constitutional competence of the supreme administartive court is to rewiev law regulations.
