Methodology of Investigating the Crime of Rape

Abstract:

Diplomová práce pojednává o metodice vyšetřování trestného činu znásilnění jak z teoretického, tak i praktického hlediska. Jako hlavní cíl si klade podat popis procesu a analýzy metodiky vyšetřování trestného činu znásilnění. Teoretická část je pro orientaci v dané problematice zaměřena na historický vývoj znásilnění až po současnou právní úpravu dle trestněprávního pojetí. Dále se zabývá kriminologickým pojetím včetně typologií znásilnění a možných příčin páchání. Práce se rovněž věnuje popisu kriminalistické charakteristiky znásilnění vyjma rozboru jejích komponentů. Nejobsáhlejší kapitola rozebírá samotnou metodiku vyšetřování znásilnění a nejvíce využívané vyšetřovací úkony pojící se s tímto trestným činem. Praktická část zahrnuje vlastní empirické šetření. Nejprve je založena na zpracování statistických dat a jejich analýze, čímž zkoumá stav, strukturu a dynamiku trestného činu znásilnění na území České republiky. Rovněž prezentuje praktické poznatky získané analýzou trestních spisů týkajících se případů znásilnění. V neposlední řadě obsahuje kvalitativní výzkum, jehož vedlejším cílem je odhalit specifické problémy doprovázející proces vyšetřování tohoto trestného činu. Kvalitativní výzkum je uskutečněn formou rozhovorů realizovanými s příslušníky Policie České republiky.

Abstract:

The diploma thesis deals with the methodology of the investigation of the crime of rape from both a theoretical and a practical point of view. The main goal is to provide a description of the process and analysis of the methodology of the investigation of the crime of rape. The theoretical part is focused on the historical development of rape crime, resulting in the current law from the point of view of criminal law for orientation in the given issue. It also deals with the criminological concept, including typologies of rape and possible causes of committing this crime. The thesis also deals with the description of the criminalistics characteristics of rape, except for the analysis of its components. The most comprehensive chapter discusses the very methodology of rape investigation and the most frequently used investigative actions related to this crime. The practical part includes its dedicated empirical investigation. It relies on the processing of statistical data and their analysis, which examines the state, structure, and dynamics of the crime of rape in the territory of the Czech Republic. Its purpose is to present practical knowledge gained from the analysis of criminal files related to cases of rape. Last but not least, it contains qualitative research, the secondary goal of which is to identify specific problems accompanying the process of investigating this crime. Qualitative research is carried out in the form of interviews conducted with members of the Police of the Czech Republic.
