Probation, mediation and social work in criminal justice

Abstract:

Bakalářská práce je zaměřena na výkon alternativních trestů, provádění úkonů Probační a mediační služby, její vznik, specifickou činnost v oblasti sociální práce, její postavení a úkoly. V prvních kapitolách práce jsou vysvětleny pojmy kriminalita a trest, neboť bez zločinu není trestu a není trestu bez viny. V bakalářské práci jsou popsány podmínky pro udělování alternativních trestů, jak byly nastaveny v České republice a také rozdíl mezi restorativní a retributivní justicí. Předkládaná práce se věnuje probaci a mediaci, přiznání odpovědnosti pachatele za spáchaný trestný čin, jeho začlenění zpět do společnosti a také zohledňování potřeb poškozeného. Cílem bakalářské práce je zjistit, zda je výkonem alternativního trestu domácího vězení naplněn účel a smysl trestu, a to nejen pro odsouzeného a oběť trestného činu, ale i pro společnost; zda je skutečně vhodnou alternativou trestu odnětí svobody.

Abstract:

Bachelor´s thesis is focused on the execution of alternative punishments, the implementation of acts of the Probation a Mediation Service, its origin, specific activities in the field of social work, its position and tasks. In the first chapters of the thesis the concept of crime and punishment are explained, because without crime there is no punishment and there is no punishment without guilt. The bachelor thesis describes the conditions for granting alternative punishments, as they were set in the Czech Republic, as well as the difference between restorative and retributive justice. The presented work deals with probation, mediation, acknowledging the responsibility of the offender for the committed crime, his integration back into society and also taking into account the needs of the victim. The aim of the bachelor´s thesis is to find out whether the purpose and meaning of punishment is fulfilled by the execution of an alternative sentence of house arrest, not only for the convict and the victim of the crime, but also for society; whether it is really a suitable alternative to imprisonment.
