Municipal Police, its Feature and Rank in the System of Public Administration it the Czech Republic

Abstract:

Cílem této diplomové práce bylo charakterizovat obecní policii a její místo v obci a ve veřejné správě celkově, zabývat se pravomocemi obecních policií, srovnat oprávnění a celkové postavení obecní policie s Policií České republiky a rozebrat právní úpravu policií místního typu v jiných evropských zemích. Právní úprava obecní policie a jejího fungování není zatím dokonalá. Byla ukázána místa, která byla již novelami upravena a jejichž současná úprava je již dostačující. Na druhou stranu byla zmíněna i ustanovení, která ještě vyžadují legislativní úpravu - například požadavky kladené na výkon povolání strážníka obecní policie (které jsou v některých aspektech náročnější než požadavky kladené na příslušníky Policie ČR), nevhodně vymezená věcná působnost obecní policie či nejasný výklad některých pojmů v zákoně o obecní policii použitých, což vyvolává interpretační konflikty, které nám pomáhá řešit pouze judikatura soudů. U těchto oblastí jsem doporučila vhodné změny v zákonné úpravě. Paralelní fungování obecních policií a Policie České republiky, sjednocované vzájemnou spoluprací, jsem zhodnotila jako fungující a takovéto zajišťování bezpečnosti mi přišlo opodstatněné. Z komparace s Velkou Británií a Francií je patrné, že trend ve vytváření bezpečnostních sborů místního typu není typický jen pro Českou republiku, ale i pro ostatní evropské země. Z této práce vyplynulo, že bezpečnostní složky místního typu mají svůj význam a jejich zakládání je opodstatněné. Práce přinesla komplexní přehled o obecních policiích, jejich fungování a jejich místu v našem státě.

Abstract:

The goal of this diploma work was to define municipal police, rank in the system of public administration, to define duties of the municipal police and to compare them with duties of state police in the Czech Republic and to compare legal rights in other European countries. Legal status of the municipal police is not perfect at this time. There were found weak parts, which were renewed by amendment of laws and are sufficient now. On the other hand there were mentioned legal regulations which need further amendments – demands on the execution of occupation of the local policeman (which can be in some aspects greater then demands of state policeman), not exactly formulated range of activities of the municipal police or unclear formulation of some terms in Municipal police Act, which can bring interpretation conflicts, which can be solved with help of decisions of courts only. I have in this sense some amendments recommended. Parallel functioning of municipal policies and Police of the Czech Republic, which are organized and coordinated by common collaboration, I have evalueted full functioning and this way of security assurance as sufficient. From comparation with France and Great Britain is clear, that the trend in assurance security of the citizens is not typical for the Czech Republic only, but for the other european countries as well. From this diploma work seems to be clear, that local security bodies are meaningfull and their establishment is reasonable. The work has brought complex overview about municipal polices, their functioning and position in our state.
