The Principles of Subsidiarity and Proportionality in the EU Competition Law

Abstract:

Cílem této práce bylo poskytnout ucelený pohled na uplatňování zásady proporcionality a subsidiarity, jako dvou základních principů zákonnosti evropského práva, v oblasti hospodářské soutěže a na základě soudní praxe prosazování těchto principů stanovit možnosti budoucí evropské právotvorby. Na základě poznatků, uvedených v této práci, je třeba konstatovat, že navzdory již téměř dvacetileté kodifikaci obou zásad v primárním právu je především princip subsidiarity v praxi obtížně prosaditelný. V oblasti práva hospodářské soutěže si však již našel své cesty a to formou přerozdělení kompetencí mezi orgány Evropské unie a orgány členských států.

Abstract:

The aim of this study was to provide a comprehensive view of application of the principle of proportionality and subsidiarity, as the two basic principles of legality of the European law, the competition law and judicial practice on the enforcement of these principles. The other aim was to determine the possibility of a future European legislative process.On the basis of the information contained in this work, it should be noted that despite nearly twenty years the codification of both principles in primary legislation is primarily the principle of subsidiarity in practice difficult to consolidate. In the area of competition law, however, has found its way in the form of redistribution of powers between EU institutions and Member States.
