Avoidance of Double Taxation

Abstract:

This bachelor thesis is dealing with double taxation of the international income and with possibilities of its avoidance. It focuses mainly on dependent personal services of natural persons and its income taxation. This is the matter that becomes more and more important in these days of open global markets. The first and the second chapter introduce the basic information that is necessary to understand the whole issue and also define the institutes which are used in the legislative. The international agreements about double taxation avoidance as the most important instruments for double taxation avoidance are analysed in the third chapter. Especially model conventions of OECD and UN are subjects of analysis because most of the bilateral treaties are contracted on their basis. Also European community efforts are indicated in this chapter. The next chapter describes specific methods used to actual avoidance of double taxation from the international and intrastate point of view of Czech Republic and Slovak Republic. The last chapter illustrates a simulated situation of natural person who gains income from three different countries of Czech Republic, Slovak Republic and United Kingdom. It further analyses determination of residency and practical methods of avoiding the double taxation in order to calculate the tax obligation of this taxpayer. It uses particular articles from the international treaties between CR and SR and between CR and UK.

Abstract:

Táto bakalárska práca sa zaoberá dvojitým zdanením medzinárodných príjmov a možnosťami jeho zamedzenia. Zameriava sa predovšetkým na zdanenie príjmov fyzických osôb zo závislej činnosti, čo je otázka, ktorá v súčasnej dobe otvorených trhov a previazaných ekonomík naberá na význame. Prvá a druhá kapitola práce prezentujú základné informácie potrebné k pochopeniu celej problematiky a definujú pojmy, s ktorými pracuje legislatíva. V ďalšej kapitole sú rozobraté medzinárodné zmluvy o zamedzení dvojitého zdanenia ako najdôležitejší nástroj regulácie tejto oblasti. Priestor je venovaný najmä modelovým zmluvám OECD a OSN, z ktorých väčšina ostatných medzištátnych zmlúv vychádza. Naznačená je aj komunitárna úprava a snahy Európskej únie. Predposledná kapitola sa venuje popísaniu metód, ktoré sa používajú k faktickému vylúčeniu dvojitého zdanenia v praxi, jednak z vnútroštátneho pohľadu Českej republiky a Slovenskej republiky a tiež podľa medzinárodnej úpravy. Posledná kapitola ukazuje fiktívnu situáciu fyzickej osoby, ktorá poberá príjmy zo závislej činnosti zo zdrojov z Českej republiky, Slovenskej republiky a Veľkej Británie. Na takomto praktickom príklade následne rozoberá určenie rezidencie osoby a konkrétne použitie metód vylúčenia dvojitého zdanenia pre výpočet daňovej povinnosti poplatníka. K tomuto účelu používa zmluvy o zamedzení dvojitého zdanenia medzi ČR a SR a medzi ČR a VB.
