Circumvention of agency employment, illegal agency, reasons for existence and recourse.

Abstract:

Tato bakalářská práce se zabývá agenturním zaměstnávání. V práci je zpracována historie i současnost agenturního zaměstnávání v České republice. Hlavní pozornost je pak věnována obcházení agenturního zaměstnávání. A to jak agenturami práce a uživateli, tak takzvanými „pseudoagenturami“. Práce obsahuje popis postavení agenturních zaměstnanců a porovnání s postavením kmenových zaměstnanců. Dále se věnuje jednotlivým účastníkům agenturního zaměstnávání a účastníkům obcházení agenturního zaměstnávání. Ve čtvrté kapitole jsou uvedeny nejčastější formy obcházení legislativy. V následné kapitole je pak dán prostor pro popis současné praxe provádění kontrol a jsou navrhnuty možné změny, které by mohly zjednodušit a zefektivnit ochranu zaměstnanců a dodržování platné legislativy a smyslu agenturního zaměstnávání jako pevného článku trhu práce.

Abstract:

This bachelor’s thesis deals with agency employment. It describes the history and current state of agency employment in the Czech Republic with the main focus on circumvention of the agency employment status both by standard private employment agencies and their clients as well as by so called pseudo-employment agencies. The thesis describes the status of temporary agency workers in comparison with the status of user undertaker employees. Further, it concentrates on individual participants of standard agency employment and participants of circumvented agency employment. In the fourth chapter, the most frequent forms of legislative circumvention are presented. The following chapter is devoted to current audit methods of the State Labour Inspection Office. Finally, the thesis suggests possible changes that could make the protection of temporary assignment employees and observation of the legislation inforce more efficient so that agency employment could become an integral part of labour market.
