Analysis of Solvency II in the Czech Republic

Abstract:

Tato diplomová práce si klade dva základní cíle. Jedním je analýza úrovně transponování požadavků stanovených novým regulačním předpisem Evropské unie Solventnost II do českého právního řádu. Druhým cílem je zhodnocení připravenosti vzorové pojišťovací společnosti na plnění nově nastavených pravidel. K tomuto účelu byla vybrána Kooperativa pojišťovna, a.s., která je jedním z největších subjektů českého pojistného trhu. Práce je rozdělena do čtyř hlavních kapitol. První kapitola se zaměřuje na vývoj regulace pojišťovnictví v evropském právu a představuje stávající regulatorní rámec Solventnost I. Zároveň se pokouší o definici největších nedostatků tohoto systému, jež vedly k přípravě nové regulace Solventnost II. Té je věnována druhá kapitola obsahující základní informace a charakteristiky směrnice. Součástí této části je rovněž popis kvantitativních dopadových studií, které představovaly významné kroky v přípravě návrhu. Ve třetí kapitole se seznámíme s procesem transponování nových požadavků do českého právního řádu. Poslední kapitola představuje vybranou vzorovou pojišťovnu a následně se pokouší o zhodnocení její připravenosti na plnění požadavků nového regulatorního režimu. V závěrečné části práce byly na základě získaných poznatků vyvozeny závěry, které vedly k naplnění stanovených cílů práce.

Abstract:

This diploma thesis puts emphasis on two fundamental goals. One of these goals is analysis of transposing levels of requirements that are established into the Czech legal code by New solvency regulations II of the European Union . The second goal is assesment of readiness of exemplary insurance company for assumption of new regulations. There has been chosen Kooperativa insurance corp. which is one of the biggest Czech insurance entities. Thesis is devided into four chapters. The first chapter is focused on the development of insurance regulation in European law and it is constituted by regulative Solvency I framework . This chapter tries to define the biggest lack of this system that helped to prepare New solvency regulations II. The second chapter is focused on fundamental information and direction characteristics. The part of this chapter is description of quantitative studies that were important steps in preparation of draft proposal. The third chapter informs about the process of transponing new requirement into the Czech legal code.The last chapter deals with the chosen insurance company and subsequently tries to evaluate its readiness for meeting requirements of new regulatory regime. The final part of the thesis has drawen conclusions that resulted in realization of given goals of the thesis.
