Abstract:

Tématem této diplomové práce je řízení o rozvod manželství. V první části je tato diplomová práce zaměřena na historický vývoj institutu rozvodu manželství a jeho právní úpravu na našem území. Dále práce projednává obecně o řízení o rozvod manželství, konkrétně obsahuje prameny hmotného i procesního práva, jež se vztahují na předmětnou problematiku, základní pojmy, procesní subjekty a hmotněprávní úpravu rozvodu manželství. Práce také obsahuje informace o samotném průběhu řízení o rozvod manželství, například návrh na zahájení řízení, jednání a dokazování. V neposlední řadě se práce zabývá právní úpravou řízení o rozvod manželství na Slovensku. Závěrem práce jsou úvahy nad právní úpravou řízení o rozvod manželství de lege ferenda.

Abstract:

The topic of this thesis is the management of divorce. The first part of this thesis focuses on the historical development of the institution of divorce and its legal regulation in our territory. Furthermore, the thesis generally discusses the procedure of divorce, specifically including sources of substantive and procedural law related to the subject matter, basic concepts, procedural parties, and substantive regulation of divorce. The thesis also contains information about the course of divorce proceedings itself, such as the proposal for initiating proceedings, hearings, and evidence. Finally, the thesis deals with the legal regulation of divorce proceedings in Slovakia. In conclusion, the thesis includes reflections on the legal regulation of divorce proceedings de lege ferenda.
