Development of Connecting Factors Associated with Natural Persons

Abstract:

The diploma thesis deals with Conneting factor, as one of the institutes of International law. In the introductory part it defines the basic concepts of private international law whereas it is a prerequisite for further understanding of the next chapters. The aim of the thesis is to analyze the different types of connecting factors associated with natural persons. The main part is dedicated to the historical development, from ancient times to the present. It is followed by definitions of the relevant connecting factors on the international stage. The thesis also outlines the problems attached to them and describes the basic advantages and disadvantages which each connecting factor brings with itself.

Abstract:

Diplomová práca sa zaoberá hraničným určovateľom (kolíznym kritériom) ako jedným z inštitútov medzinárodného práva súkromného. V úvodnej časti sú definované základné pojmy, pochopenie ktorých je stavebným kameňom pre porozumenie ďalších kapitol. Cieľom práce je analyzovať rôzne druhy hraničných určovateľov spojených s fyzickými osobami. Hlavnou časťou je kapitola venovaná ich historickému vývoju a to od dôb staroveku až po súčasnosť. Nasleduje samotné vymedzenie predmetných kolíznych kritérií na medzinárodnom poli. Súčasťou je tiež načrtnutie problémov, ktoré s nimi súvisia a popísanie základných výhod a nevýhod, ktoré uplatňovanie konkrétnych hraničných určovateľov so sebou prináša.
