Abstract:

Má diplomová práce je pohledem na právní aspekty sexuální problematiky, konkrétně na sexuální delikt jako takový, jeho pachatele, ale také druhou stranu, snad nejvíce dotčenou tímto protiprávním chováním, a to oběť. Důvodem, proč jsem si vybrala toto téma diplomové práce je to, že bych si chtěla utřídit poznatky v úpravě tohoto právního odvětví a také bych chtěla porovnat teoretické poznatky s praxí týkající se především trestných činů, které vyšetřují policejní orgány v ČR, konkrétně v Jihomoravském kraji. Pokusím se zachytit základní problematiku právní úpravy, její vývoj a také svůj vlastní pohled do budoucna, s návrhem možného dalšího zlepšení či postupů – tedy součástí práce je stav de lege lata a úvaha de lege ferenda. Svou práci bych rozdělila na dvě části, a to část teoretickou a prakticko-aplikační. V části prvé budu psát o sexualitě obecně, budu popisovat jednotlivá stadia vývoje spolu se sexuálními deviacemi a sexuálními motivacemi. Neméně důležitou částí je i obecný pohled na pachatele z psychologického a právního pohledu, na osobnost pachatele znásilnění a pohlavního zneužívání.

Abstract:

My diploma shows the legal aspects of sexual problems particularly the sexual offence itself, a perpetrator as well as the other side, perhaps the most affected by the offence, which is a victim. The reason why I have chosen the theme of the diploma is that I wanted to organize information of this particular legal section and furthermore to compare theoretical and practical knowledge concerning criminal offences being investigated by the Police of the South Moravian region. Not only will I try to describe the fundamental problem of the legal modification and its development but I will also express my own view with a suggestion of improvements and procedures so the diploma includes a state of ´´de lege lata´´ and a consideration of ´´de lege ferenda´´. The diploma is divided into two main parts a theoretical and a practical focused on application in real life. The first part concerns sexuality in general and I will describe each stages of its development with indecent assault and motivations. Also very important is a part where a perpetrator is considered from the psychological and legal point of view and a personality of a perpetrator and sexual abuse. Classification of a perpetrator is of vital importance in terms of qualification of a commited criminal offence and decision for possible solution or the grade of punishment.
