The Interpretation of Article 9 of the Japanese Constitution

Abstract:

Předmětem této bakalářské práce je Článek 9 japonské ústavy, který ve svém znění zamítá vést válku a zcela zavrhuje udržování válečného potenciálu. Interpretace tohoto článku prošly jistým vývojem od doby jeho stanovení v roce 1947, což má za následek zásadní změny v bezpečnostní politice Japonska. Práce se zabývá těmito interpretacemi zmíněného článku a uvádí jejich vliv na bezpečnostní politiku. Důraz je kladen především na proces formulace první interpretace Článku 9, jelikož díky ní bylo opět umožněno vyzbrojení Japonska. Práce zahrnuje také otázku, jaký vliv na roli japonských Sil sebeobrany mají nová legislativa a vzájemné dohody mezi Japonskem a Spojenými státy americkými. Pomocí metod analýzy a syntézy je v práci chronologicky popisován vývoj událostí a změn v bezpečnostní politice Japonska v souvislosti s interpretacemi Článku 9 japonské ústavy. Tento článek se stal hlavním nástrojem japonské vlády pro utváření bezpečnostní politiky Japonska. Přestože jeho interpretace a z nich plynoucí změny v bezpečnostní politice nezůstaly stejné, samotný článek přetrval ve svém původním znění beze změny jediného slova. Z pohledu vnitřní politiky země byla hlavním aktérem ve změnách role japonských Sil sebeobrany Liberálně demokratická strana, zatímco z pohledu vnější politiky stály téměř za každou změnou USA prostřednictvím japonsko-amerických vzájemných dohod. Tyto změny mají za následek, že role Sil sebeobrany již nespočívá v pouhé obraně státu, jak byla původně zamýšlena, a není tedy zcela v souladu s Článkem 9 japonské ústavy. K těm nejzásadnějším změnám patři možnost vysílání japonských jednotek na mezinárodní operace od roku 1992, přičemž v roce 2015 bylo v Japonsku nově schváleno právo na kolektivní sebeobranu, jehož důsledkem bylo vyslaným jednotkám umožněno účastnit se bojových akcí v zahraničí. Je tedy zřejmé, že současný účel Sil sebeobrany se liší od toho původního, což vzneslo otázku, zda je stále plně v souladu s ústavou.

Abstract:

This bachelor thesis analyzes the Article 9 of the Constitution of Japan, renouncing war and prohibiting war potential. More than one interpretation of the Article 9 has been made since the constitution came into effect in 1947, which has resulted in major changes in the defense policy of Japan. Firstly, these interpretations are examined in detail in the thesis. Secondly, their influence on the policy of Japan is considered. The process of formulation of the first interpretation is emphasized as it enabled rearmament of Japan. The issue of the impact of the U.S.-Japan bilateral treaties and new Japanese legislation on the Japanese Self-defense Forces (SDF) is also examined in the thesis. The thesis describes the development of changes in the defense policy of Japan in connection with interpretations of the Article 9 of the Constitution of Japan with the use of the methods of analysis and synthesis. The thesis stresses the fact that the Article 9 has become the main instrument of the Japanese government to develop the defense policy of Japan. Despite many changes in its interpretations, which altered the defense policy, the Article 9 remained without a single word being revised. The Liberal Democratic Party of Japan has undeniably had the greatest influence on the alterations of the role of the JSDF. However, on the international scale it has undoubtedly been the USA, who supported nearly all the changes via the U.S.-Japan treaties. As a result of these changes, the purpose of the JSDF lies no more solely within the defense of the country, which was the initial purpose, and therefore no longer fully corresponds with the Article 9 of the Constitution of Japan. The list of fundamental changes includes the possibility to dispatch Japanese military forces to aid attacked overseas countries in existence since 1992 and a new law giving Japan the right of collective self-defense which passed by the Japanese government in 2015. On the grounds of this law, the dispatched Japanese military forces are enabled to participate in combat operations abroad. It is thus evident that the initial purpose of the JSDF has been altered. As a result, the question whether it still remains in conformity with the Constitution has arisen.
