Administrative delicts in the healthcare sector

Abstract:

Bakalářská práce je zaměřena na právní úpravu přestupků na úseku zdravotnictví a analýzu jednotlivých přestupků. Nejprve je obecně vymezena odpovědnost a řízení o přestupcích. Největší důraz je kladen na přestupek odmítnutí očkování dítěte, u kterého je zásadní problém ve střetu právem chráněných zájmů. V práci je také zhodnocen vývoj v judikatuře Nejvyššího správního soudu a Ústavního soudu. Zároveň je provedena komparace české právní úpravy očkování s rakouskou a francouzskou.

Abstract:

The Bachelor work is focused on legal rules governing administrative delicts in the healthcare sector and analysis of individual administrative delicts. First of all, responsibility for administrative delicts and administrative proceedings are generally defined. The greatest emphasis is put on administrative delicts connected with rejection of child immunization, in which the fundamental issue of a conflict of interests protected by law needs to be solved. The development of the Supreme Administrative court's and the Constitutional court's case law is discussed in the work as well. At the same time, a comparison of the Czech, Austrian and French legislations on vaccination is carried out at the end of the work.
