Participation of the public interest in the decision-making process in the public administration

Abstract:

V období před demokratickými změnami v naší zemi bylo zcela běžné užívat pojmy „veřejný zájem“ a „státní zájem“ jako synonyma. Po roce 1989 dochází k výraznému posunutí pozice práva jednotlivce a tedy i „soukromého zájmu“. Paradoxní je, že veřejný zájem je pojmem velice frekventovaným, je součástí celé řady zákonů, avšak jeho jednoznačná definice chybí. Je logické, že mnohdy se zájmy soukromé a veřejné rozcházejí. V demokratické společnosti nebývá neobvyklé, že je přihlédnuto k právům jednotlivce, třebaže je protivníkem stát. Časté jsou též rozpory mezi zájmy, které je možno v obou případech označit za veřejné (ekologie versus dálniční sítě). Autor se ve své diplomové práci zaměřuje nad participací veřejného zájmu v rozhodovacím procesu veřejné správy. Zamýšlí se též nad případnými konflikty mezi soukromým sektorem, územní samosprávou či nevládními neziskovými organizacemi. Tento problém aplikuje v podmínkách hlavního města Prahy. Obecné aspekty pak prezentuje na konkrétním případu rozhodování v environmentální oblasti.

Abstract:

In the period before the democratic changes in our country it was quite common to use the terms “public interest “ and “state interest” as synonyms. Since 1989 there has been a considerable movement in the position of the right of individual and thus “private interest”. Ironically enough, public interest is the term frequently used, featuring in a whole series of laws, but its clear definition is missing. It is logical that private interests and public ones differ on many occasions. In a democratic society it does not tend to be usual to disregard the rights of individual, even though a state is the only opponent. There are frequent conflicts between the interests which can be declared in both cases as public ones (ecology versus motorway network). The author of this Thesis deals with participation of public interest in a decision-making process of public administration. He reflects on possible conflicts among a private sector, territorial authority or nongovernmental non-profit making organizations. He applies this problem in the conditions of the capital Prague. Then he presents these general aspects on the particular case of decision-making in the environmental field.
