Idea-Expression Dichotomy in the Copyright Protection of Videogames

Abstract:

V této práci se zabývám principem idea-expression dichotomy v autorském právu, přičemž se zaměřuji na projevy tohoto principu v kontextu autorskoprávní ochrany videoherního designu. Cílem a účelem mého zkoumání je poznat esenciální a unikátní prvky videoherního designu, jež se v jiných formách uměleckého vyjádření neobjevují, konfrontovat je s principem idea-expression dichotomy a zhodnotit, jakým způsobem se tento princip promítá do efektivní autorskoprávní ochrany takového autorského díla, a to zejména v doktrinálním a judikaturním přístupu. Úvodem vymezuji pojmové znaky videohry jako média svého druhu, dále po-pisuji některé specifické aspekty kreativní tvorby s akcentem na videoherní prostředí, vymezuji aktuální problémy na poli videoherního trhu. Tyto pak konfrontuji s českou a americkou právní úpravou a některými formujícími rozsudky amerických soudů, které položily základy relevantní ochraně videoher i vymezily dopad principu idea-expression dichotomy do sféry jejich autorskoprávní ochrany. Závěrem pak hodnotím aktuální právní vymezení autorskoprávní ochrany videoher s přihlédnutím ke specifickým aspektům tohoto média, stejně jako schopnost práva omezit některé nekalé praktiky ovládající současný videoherní trh.

Abstract:

In this thesis I deal with the idea-expression dichotomy principle in copyright with focus on the manifestation of this principle in the context of copyright protection of video game design. The goal of my research is to identify essential and unique aspects of video game design, as opposed to other forms of artistic expression, to confront those with the idea-expression dichotomy principle and to learn the manner in which this principle affects effective copyright protection of this creative work, and to do so in the point of view of both doctrine and judgemental practice. At the beginning, I define what I find being the determining aspects of video game as a medium of its kind. I then continue to describe some of the specific elements of creative work with special consideration of video game making. I use these in confrontation with both Czech and American legislation and some of the crucial judgements of American courts, which laid the foundation of the video game copyright protection as well as determined the impact of the idea-expression principle into the copyright protectability of video games. In conclusion, I evaluate current legislative basis of videogame copyright protection with consideration of unique aspects of this medium, as well as the capability of current legislation to effectively protect video game creators from some of deceitful practices present in videogame market nowadays.
