Legal Pre-emption Right of Co-owners

Abstract:

Tato diplomová práce se zabývá zákonným předkupním právem spoluvlastníků s ohledem na novelu č. 460/2016 Sb. zákona č. 89/2012 Sb., občanský zákoník. Po obecném vymezení a charakteristice předkupního práva se práce věnuje historickému vývoji tohoto právního institutu a částečně i komparaci s vybranými evropskými státy. Dále se tato práce zabývá realizací zákonného předkupního práva spoluvlastníků s ohledem na aktuální problémy. Největší pozornost je věnována předkupnímu právu spoluvlastníků spojeného s garážovým stáním a navržení možných řešení tohoto problému. Speciální kapitola se pak zabývá otázkou použitelnosti judikatury Nejvyššího soudu do roku 2013.

Abstract:

The thesis deals with the legal pre-emptive right of the co-owners with regard to the amendment to Act No. 89/2012Coll. The Civil Code. After the general definition and characterization of pre-emptive right the thesis deals with the historical development of this legal institute and with the comparison with selected European states. Further this thesis deals with the implementation of the legal pre-emptive right with regard to the current problems. The greatest attention is paid to the legal pre-emptive right of the co-owners to the garage and the possibility of solving this problem. A special chapter deals with the question of the applicability of Supreme Court rulings until 2013.
