Interference in the personal integrity and protection by a health care assistance

Abstract:

Předmětem této práce je rozbor ochrany základních právních hodnot pacienta při poskytování zdravotní péče. Úvodní část je zaměřena na specifikum právního vztahu lékaře a pacienta, a rozbor základních lidsko-právních dokumentů vztahujících se k tématu. Těžiště práce je orientované na autonomní vůli a soukromí, jako základní hodnoty pacienta. Pozornost je věnována institutu informovaného souhlasu, a to především způsobilosti dát tento souhlas a poučení před zákrokem. Prostor je věnován také problematice nucené hospitalizace. Část ochrany soukromí se zaměřuje na mlčenlivost zdravotnických pracovníků. V návaznosti na ty to vztahy a z nich plynoucí odpovědnost je v závěrečné části řešena otázka náhrady vniklé újmy a její pohled na odškodnění v případě porušení osobnostních práv. Průběžně text práce také poukazuje na komparaci stávající české právní úpravy s jinými právními řády. V neposlední řadě je zmíněn pohled nového občanského zákoníku na danou problematiku.

Abstract:

This thesis is an analysis of the legal protection of fundamentala values in the provision of health care assistance. The introducory part is derected to the specific legal realationship between physician and patient, and analysis of basic legal human documents related to the topic. The focus of the work is oriented on autonomous will and privacy as a fundamental value of the patient. Attention is paid to the Institute of informed consene, particularly the qualification to give consent and content and content of instruction before surgery. Space is also devoted to the issue od forced hospitalization. Part protection of patient privacy is then focused on the confidentiality of health staff. building on these relationships and the resulting liability is in the final section dealth with the question of compensation for damage and ingress of its view of the compensation in case of violation of personal rights. Ongoing work also highlights text on a comparison of current Czech legislation with other jurisdictions. Finally, it is mentioned view of the new Civil Code on the issue.
