Abstract:

Diplomová práce se zabývá pojmem parodie a definuje základní znaky, které lze v rámci interpretace pojmu v souvislosti s rozborem judikatury nalézt. Parodie je podrobena analýze z hlediska základních lidských práv a svobod a je zasazena do kontextu vnitrostátní i unijní právní úpravy. Práce podává ucelený přehled o institutu parodie, dedukuje podmínky, za kterých lze dílo za parodii považovat, a analyzuje judikaturu za účelem sestavení mezí legálnosti a nelegálnosti parodie.

Abstract:

The thesis deals with the concept of parody and defines the basic features which can be found within the interpretation of the term in connection with the analysis of case law. Parody is subjected to analysis in terms of fundamental human rights and freedoms and contextualized in national and EU legislation. Work gives a comprehensive overview of the parody institute, deduces the conditions under which the work can be considered as a parody and analyzes case law in order to establish the limits of legality and illegality of a parody.
