Consumer protection in civil law

Abstract:

The issue of consumer protection is both humane and sensitive topic and at the same time it is an important factor influencing the movement of goods and services in an integrated internal market. Importance of this issue lies in the fact that a weaker position of consumer in the market is corrected by government with using mandatory standards, in order to ensure him a high level of protection and to increase public confidence in the internal market. Acquaintance with the progress of this issue and the various sources of law will enable a better understanding of the current legislative arrangements, as well as its possible shortcomings, whether due to lack of concept or inconsistency in harmonization of Slovak law with European Community law. We analyzed the legal concept of consumer contracts with reference to the unfair terms and the main concepts of consumer policy by comparing with the legislation in the European Union. The main objective of consumer protection regulation is an effort to achieve de facto equality of contractors with constraining of a contractual freedom and the practical application of the various legal instruments in terms of the European Communities under the principle of subsidiarity, by institutions at national and community level.

Abstract:

Problematika ochrany spotrebiteľa je jednak ľudsky citlivá téma a zároveň je významným faktorom, ovplyvňujúcim pohyb tovarov a služieb na jednotnom vnútornom trhu. Význam tejto problematiky spočíva v tom, že slabšie postavenie spotrebiteľa na trhu štát koriguje kogentnými normami, v snahe zabezpečiť mu vysokú úroveň ochrany a zvýšiť tak dôveru verejnosti vo vnútorný trh. Oboznámenie sa s jej vývojom a jednotlivými prameňmi práva umožní lepšie pochopenie súčasnej legislatívnej úpravy, ako aj jej prípadných nedostatkov, či už v dôsledku nekoncepčnosti alebo nedôslednej harmonizácie právneho poriadku Slovenskej republiky s právom Európskeho spoločenstva. Analyzovali sme právny inštitút spotrebiteľských zmlúv s poukazom na neprijateľné podmienky a hlavné pojmy spotrebiteľskej politiky, komparáciou s právnou úpravou na úrovni Európskej únie. Hlavným cieľom regulácie ochrany spotrebiteľa je snaha o dosiahnutie faktickej rovnosti kontrahentov obmedzením zmluvnej voľnosti a praktické uplatňovanie jednotlivých právnych nástrojov v podmienkach Európskych spoločenstiev na základe zásady subsidiarity, a to prostredníctvom inštitúcií na národnej aj komunitárnej úrovni.
