Liability for Damage Caused by Animals

Abstract:

Tato práce je zaměřena na odpovědnost za škodu způsobenou zvířetem, a to z pohledu práva občanského, správního a trestního. V práci budou popsány podmínky vzniku odpovědnosti a podmínky pro vznik nároku na náhradu újmy, přičemž bude kladen důraz na zachycení odlišností a spojitostí mezi uvedenými třemi právními odvětvími. V práci bude pracováno s odpovědností za újmu způsobenou zvířetem v širším pojetí, neboť právo správní ani právo trestní přímo pojem odpovědnost za škodu způsobenou zvířetem nezná, nicméně odpovědnost za zvíře je nepřímo upravena i těmito právními odvětvími.

Abstract:

The tesis focuses on liability for damage caused by animals from the point of view of the civil, administrative, and criminal law. The thesis will describe conditions under which the liability, as well as the right to claim compensation for damage, are established, with a special focus on the differences and similarities between the free bodies of law. Neither administrative nor criminal law uses the term „liability for damage caused by animals“. Nevertheless, these bodies of law treat this subject, therefore, the thesis will consider the liability for damage caused by animals in its wider mening.
