Group Actions

Abstract:

Tato diplomová práce se zaměřuje na komplexní analýzu hromadných žalob. Je rozdělena do dvou systematických celků, kdy se první věnuje tématu v obecné rovině a druhý přibližuje specifické atributy samotného řízení. V první kapitole je rozebrána problematika terminologie a dále je zde uvedena klasifikace s popisem jednotlivých typů hromadných žalob. Celou kapitolu uzavírá výčet a deskripce výhod, které tento institut nabízí. Část zabývající se soudním řízením je pak plně dedikována procesní stránce fenoménu. V úvodu kapitoly jsou nejprve vymezena právní odvětví a žalobní nároky nejpříhodnější pro aplikaci hromadných žalob. Na zmíněné navazuje analýza typických znaků hromadné žaloby doplněná o popis tzv. certifikačního řízení. Následující podkapitola se zaměřuje na způsoby určení členů skupiny dotčené probíhajícím řízením, a to pomocí metody opt-in či opt-out. Úplný závěr práce se zabývá otázkou nákladů řízení a jejich náhradou. Analýza výše uvedeného je realizována skrze studii právních úprav jednotlivých států a názorný praktický obraz v podobě relevantní judikatury.

Abstract:

This diploma thesis concentrates on a complex analysis of group actions. It is divided into two systematic units, where the first one focuses on the topic in general and the second one expounds specific attributes of a procedure itself. In the first chapter there is described a problem of terminology and then there is mentioned a classification with a description of particular types of the group actions. The whole chapter is concluded with a list and a characterization of advantages this procedural institute offers. The second part is fully dedicated to the procedural site of the phenomenon. In the introduction of the chapter there are firstly introduced branches of law and legal claims the most convenient ones for an application of the group actions. Aforementioned is followed by the analysis of typical features of the group action supplemented with a description of a so called certification procedure. Next section concentrates on means of the identification of class members affected by a process in progress using either opt-in or opt-out method. Absolute conclusion of the thesis deals with a topic of legal costs and its recovery. The analysis of aforementioned topics is performed by a study of legislations of the individual states and with a demonstrative sight of practice in a form of relevant court decisions.
