Developement of Consumer Credit Regulation and its Dispute Settlement by the Financial Arbitrator

Abstract:

Předmětem této práce je charakteristika právní regulace spotřebitelského úvěru v komparaci se staršími právními úpravami dané tématiky. Obecná část práce začíná stručným vymezením vývoje spotřebitelské politiky v Evropské unii i v České republice. Dále bude současná podoba zákona o spotřebitelském úvěru porovnána s předešlými zákony upravujícími sjednání smlouvy o spotřebitelském úvěru, s důrazem na změny v oblasti ochrany spotřebitele. Zvláštní část práce představí finančního arbitra, jako orgán, který je příslušný k řešení sporů ze spotřebitelského úvěru mimosoudní cestou. Poté je konkretizován průběh řízení před finančním arbitrem se všemi jeho náležitostmi. V poslední kapitole práce jsou řešeny tři reálné případy, které se před finančního arbitra dostaly. Jde o případy, ve kterých došlo k zamítnutí spotřebitelova návrhu, ve snaze poukázat na fakt, že přestože se jedná o orgán s vlídným přístupem ke spotřebitelům, rozhoduje finanční arbitr vždy nestranně.

Abstract:

The aim of this thesis is to characterize the legal regulations of consumer credit in comparison with the older regulations. The first part of the thesis provides a brief description of the development of consumer credit policy in the European Union as well as in the Czech republic. In the next chapter, the current form of the law dealing with consumer credit is compared with the earlier laws governing the contact of consumer credit with the emphasis on the changes made in the area of consumer protection. The second part of the thesis introduces the financial arbitrator as the authority which is competent to deal with various disputes concerning consumer credit in out-of-court proceedings. Furthermore, the proceedings of the financial arbitrator are specified with all its particulars. The last chapter deals with three real cases which reached the financial arbitrator. The cases selected are the ones which the consumer´s proposal was rejected in order to showcase the fact that even though it is a consumer friendly institution, it always arbitrates impartially.
