Right of Defence

Abstract:

Cílem této práce je čtenáři přiblížit právo na obhajobu, jež je jednou ze složek spravedlivého řízení, a tudíž jednou ze základních zásad trestního práva procesního. Práce je rozčleněna do devíti kapitol se zaměřením na uplatňování obhajovacích práv v rámci postupu v řízení tak, aby byl účel trestního řízení naplněn. První část je věnována právní regulaci obhajoby a zárukám jejího uplatnění. Následuje stručná charakteristika osob, vykonávajících v trestním řízení funkci obhajoby, a s tím související práva a povinnosti, která jim zákon přiznává, vymezení institutu nutné obhajoby a obhajoby bezplatné či za sníženou odměnu. Druhá část práce rozebírá jednotlivá obhajovací práva, která mohou být osobami zákonem oprávněnými uplatňována v rámci postupu v trestním řízení a rovněž v rámci některých tzv. zvláštních postupů v trestním řízení. Závěr diplomové práce pak shrnuje důležité informace a poznatky, ke kterým jsem dospěla, zhodnocení současné právní úpravy a možné návrhy de lege ferenda.

Abstract:

In this research paper, I have attempted to enlighten the reader about the right of defence. This right is an essential element of a just proceeding, and thus one of the basic principles of law of criminal procedure. The thesis is divided into nine chapters focusing on the right of defence in the course of criminal procedure in the way that fulfils the purpose of criminal proceedings. The first part of it deals with the sources and guarantees of the right of defence. Followed by definition the position of persons that conduct the function of defence in prosecution and accompanying rights and obligations granted to such persons by law, further necessary defence and free defence or defence for a reduced fee. Second part of this thesis analyzes individual rights of defence here that can be used by persons authorized by law within the criminal proceedings and several special procedures within criminal processing. The conclusion of the thesis sums up all important pieces of information and facts that I have dealt with. I also evaluate the current law and proposals de lege ferenda.
