Exploitative and Exclusionary Abuse of Dominant Position

Abstract:

Abstrakt Předkládaná diplomová práce se v první části věnuje analýze vývoje rozhodovací praxe Úřadu pro ochranu hospodářské soutěže (a jeho předchůdců) v oblasti zneužití dominantního postavení se zohledněním vlivu různých doktrín na toto rozhodování (české „leading cases“), včetně porovnání konzistence tuzemské rozhodovací praxe s praxí rozhodování v Evropské unii. Za tím účelem jsou v diplomové práci vždy stručně komentovány klíčové případy řešené unijními a českými orgány včetně porovnání eventuálních odlišností v posuzování podobných otázek. Druhá část diplomové práce prezentuje zdůvodněné stanovisko ke snahám o modernizaci čl. 82 SES (nyní čl. 102 SFEU) na základě analýzy jejích příčin, geneze a dosavadních výstupů.

Abstract:

Abstract In its first part, this diploma thesis deals with the analysis of the development of the practice of the Office for Protection of Economic Competition (and its predecessors) in the area of theabuse of dominant position, taking into account the influence of various doctrines on their decision-making (the Czech “leading cases”), including the comparison of the consistency of the domestic decision-making practice with the practice in the European Union. In order to do this, the key cases handled by EU and Czech authorities are briefly commented on and a comparison of possible differences in the assessment of similar issues is made. The second part of the thesis presents a reasoned opinion on the efforts at modernization of Article 82 EC (now Article 102 TFEU) on the basis of an analysis of its causes, origins and current outputs.
