Development of legal and institutional control of security sectors

Abstract:

V úvodu diplomové práce je definován pojem kontrola, který je pro tuto práci stěžejní a promítá se téměř ve všech jejích kapitolách. Dále budou strukturovaně uvedeny základní informace o všech 7 bezpečnostních sborech České republiky, jejich dělení, právní úprava, pravomoci atd. Následně se pak v samostatných kapitolách více věnuji vývoji kontroly Policie České republiky, a to jako největšímu bezpečnostnímu sboru České republiky. Dále Generální inspekci bezpečnostních sborů, jejímu vzniku a hlavním změnám jejího fungování za necelých 10 let. V jedné částí práce se zabývám činností Stálých komisí Poslanecké sněmovny a rozsahu jejich působnosti a možnosti kontroly. V neposlední řadě bude věnována pozornost i vzniku Orgánu nezávislé kontroly zpravodajských služeb České republiky, o kterém se v dnešních dnech velmi mluví a s blížícím se koncem 8. volebního období začíná narůstat polemika ohledně ustavení tohoto orgánu. Na základě rozhovorů s odborníky v oblasti bezpečnostních sborů v závěru analyzuji a vyhodnocuji, jaký by mohl být následný vývoj kontroly bezpečnostních sborů vzhledem k aktuální legislativní úpravě.

Abstract:

The introduction to the thesis defines the concept of control, which is crucial for this work and is reflected in almost all its chapters. Furthermore, basic information about all 7 security forces of the Czech Republic, their division, legislation, powers, etc. will be presented in a structured way. Subsequently, in separate chapters I pay more attention to the development of control of the Police of the Czech Republic. Furthermore, the General Inspectorate of Security Forces, its establishment and the main changes in its functioning in less than 10 years. In one part of the work I deal with the activities of the Standing Commissions of the Chamber of Deputies and the scope of their competence and possibilities of control. Last but not least, attention will be paid to the establishment of the Body of Independent Control of Intelligence Services of the Czech Republic, which is currently being talked about a lot and with the approaching end of 8th legislature approaching, controversy is beginning to grow. Based on interviews with experts in the field of security forces, I finally analyze and evaluate what could be the subsequent development of control of security forces with respect to the current legislation.
