Public regulations for a construction placement, a change in the use of an area and for the change of the construction usage impact on the area

Abstract:

Tématem této diplomové práce je problematika umisťování staveb a její zařazení do kontextu územního plánování, potažmo provádění staveb dle stavebního zákona. Kromě úvodu a závěru je práce je členěna do tří kapitol, přičemž první se věnuje charakteristice územního plánování, druhá pak popisuje jednotlivé typy územních rozhodnutí z hmotného i procesního hlediska a třetí kapitola konkretizuje veřejnoprávní podmínky pro umístění stavby, které vyplývají z předchozích požadavků jak územního plánování, tak územního rozhodování. V celé práci je kladen důraz na porovnání rozdílů předchozí právní úpravy a nynější právní úpravy, tedy po novele stavebního zákona účinné od 1. 1. 2018. V závěru se pak nachází shrnutí poznatků, které vyplývají z výše zmíněného porovnání obou právních úprav a vyhodnocení, zda novela stavebního zákona opravdu zjednoduší a urychlí proces výstavby, jak je předestřeno v důvodové zprávě.

Abstract:

The topic of this diploma thesis is the issue of the placement of buildings and their realization process in the context of spatial planning, or the implementation of constructions according to the Building Act. Besides the introduction and the conclusion, the thesis is divided into three chapters, the first one deals with the characteristics of spatial planning, the second describes individual types of territorial decisions from the material and process point of view, and the third chapter specifies the public terms for the placement of the building resulting from the previous requirements of spatial planning, and territorial decision-making. Throughout the work, emphasis is placed on comparing the differences between the previous legal regulations and the current legal regulations, i.e. after the amendment to the Building Act effective from 1st January 2018. In conclusion, there is a summary of the findings resulting from the above-mentioned comparison of the two legal regulations and the evaluation, whether the amendment to the Building Law will really simplify and speed up the construction process as it is outlined in the explanatory memorandum.
