Subject of criminal activity

Abstract:

The work is thematically focused on criminal theme, namely the offender. The task of the theory point to divide the subjects of the offense: for adult offenders (persons close to the age of the adolescent, the elderly, other adults) and juvenile offenders with sub-category. Also to the criminal responsibility of individuals (we take into account factors that affect it), and the possibility of taking criminal responsibility for legal persons (de lege ferenda). The first two chapters focus on characterizing the actual definition of the offender and his subsequent criminal responsibility for the offense, but the third chapter focuses on considerations related to the criminal liability of legal persons to which they reflect the local and foreign authors. Even now I keep wondering whether the anchor does not provide for criminal liability of legal persons in the Slovak system of criminal law. Finally, the annotations should be added that so far this responsibility has been established with us.

Abstract:

Práca je obsahovo zameraná na trestnoprávnu tematiku, a to konkrétne na páchateľa trestného činu. Úlohou bolo teoreticky poukázať na delenie subjektov trestného činu: na dospelých páchateľov (osoby blízke veku mladistvého, staršie osoby, ostatní dospelí) a mladistvých páchateľov spolu s podkategóriou. Zároveň aj na trestnú zodpovednosť fyzických osôb (zobrali sme do úvahy faktory, ktoré na ňu vplývajú) a možnosť prijatia trestnej zodpovednosti pre právnické osoby (de lege ferenda). Prvé dve kapitoly sa zameriavali na faktické vymedzenie charakterizujúce páchateľa a jeho následnú trestnú zodpovednosť za spáchaný trestný čin, ale tretia kapitola sa sústreďuje na úvahy spojené s trestnou zodpovednosťou právnických osôb, ku ktorým sa vyjadrovali autori tunajší aj zahraniční. Aj v súčasnosti si kladieme otázku zakotviť či nezakotviť trestnú zodpovednosť právnických osôb do systému Slovenského trestného práva. Na záver anotácie treba dodať, že doposiaľ táto zodpovednosť zavedená u nás nebola.
