Offenders of Hate Crimes Committed under the Drug Influence

Abstract:

Bakalářská práce se zabývá specifikací a shrnutím trestných činů z nenávisti v České republice, charakteristikou pachatelů těchto trestných činů a vlivem návykových látek na jejich jednání a rozhodování. S pojmem „trestné činy z nenávisti“ se v České republice příliš nesetkáme, častěji používanými pojmy jsou kriminalita s extremistickým podtextem a trestná činnost s rasovým, národnostním a náboženským podtextem. Motivem trestných činů z nenávisti je nenávist založená na odlišné rase, náboženství, národnosti, sexuální orientaci, pohlaví či postižení. Tato široká škála motivů k nenávisti, je nejčastěji omezena na rasový, národnostní a etnický motiv. Pozornost je také zaměřena na třídění pachatelů, podle jejich osobní motivace. Důležitými prvky pro jejich rozdělení je proces socializace, sociální status a sociální zázemí pachatele. Návyková látka působí ve všech případech jako katalyzátor, který odbourává morální zábrany a posiluje pocit bezpečí. Z návykových látek je to především alkohol, který je v České republice tradiční a dostupnou návykovou látkou, vliv ostatních návykových látek v rámci této trestné činnosti je pouze okrajový.

Abstract:

The Bachelor's thesis summarizes and specifies hate-crimes in the Czech Republic; it deals with the main characteristic of these crimes and the influence of addictive substances, which have an adverse effect on the offender’s behaviour and decision making. The Czech Republic does not often deal with the specific term of „hate-crime". The most commonly used terms are offenses of extremist, racial, national and religion overtones. Motives for these offenses and hate crimes include race, religion, nationality, sexual orientation, gender or disability, but are more commonly restricted to racial, national and ethnic motives. There is also a focus on the personal reason of each offender. Important factors for there further subdivision are the socialization process, social status and social background of the offenders. Drug use acts as a catalyst in many of these crimes, reducing moral constraints and strengthening a sense of security in the criminal. Alcohol, which is addictive and highly accessible substance, is often the drug of choice. The influence of additional drugs within the frame of this criminal activity is only marginal.
