Social harmfulness between misdemeanors and criminal offenses

Abstract:

Bakalářská práce se zabývá společenskou škodlivostí mezi přestupky a trestnými činy. Společenská škodlivost úzce souvisí s rozlišením protiprávního jednání na takové, které mohou být pouze přestupkem nebo které lze posuzovat za trestný čin. Cílem práce je zodpovězení následujících otázek. Je správně nastavena hranice mezi správním a trestním deliktem v oblasti veřejného pořádku? Je správně nastavena hranice mezi správním a trestním deliktem v oblasti ublížení na zdraví? Je správně nastavena hranice mezi správním a trestním deliktem v oblasti majetku? Zaměření je tak na skutky, které narušují veřejný pořádek, jenž se udály veřejně nebo na místě, které je veřejnosti přístupné. Dále jsou srovnány skutky ochraňující stejný zájem společenských hodnot, kterým je lidské zdraví. Následně je porovnáno majetkové protiprávní jednání přestupku a trestného činu, u nichž je základním rozlišovacím kritériem výše škody způsobené na cizím majetku.

Abstract:

The bachelor thesis deals with the social harmfulness between misdemeanors and criminal offenses. Social harm is closely linked to the distinction between offenses which may be only a misdemeanor, or which may be considered as a criminal offense. The aim of the work is to answer the following questions. Is the boundary between administrative and criminal tort in the field of public order correctly set? Is the boundary between administrative and criminal tort in the issue of personal injury correctly set? Is the boundary between administrative and criminal tort in the field of property correctly set? The focus is on acts that disturb public order that have taken place in public or in a place that is accessible to the public. Furthermore, the acts protecting the same interest of social values, which is human health, are compared. A comparison is then made between the property infringement of a misdemeanor and the criminal offence, for which the basic distinguishing criterion is the amount of damage caused to foreign property.
