LEGAL ASPECTS OF DRAMA TEXT EDITING AND ADAPTATION IN THEATRE

Abstract:

Tato magisterská práce se zabývá právními aspekty úprav dramatického textu a adaptace v divadle. Práce je rozdělena do tří částí. První část shrnuje současné autorskoprávní prostředí a právní teorii k němu se vážící. Hlavním zdrojem pro první část byl český autorský zákon, komentáře k autorskému zákonu a další právní předpisy k problematice se vážící. Druhá část práce se věnuje dramatickému textu a adaptaci z pohledu divadelní teorie a vědy. Zdrojem pro tuto část byla odborná literatura. Třetí část práce se věnuje výzkumu, sestávajícímu z dotazníku a specifických i nespecifických případů z praxe. Klíčovým zdrojem byly rozhovory s dramaturgy a pracovníky divadel. Cílem magisterské práce je popsat autorskoprávní prostředí v souvislosti s vypořádáváním licenčních oprávnění a upozornit na chyby, jimž lze předejít. Předpokládám, že autorský zákon lze snadno pochopit a aplikovat v obvyklých situacích, že intepretace dramatického textu a adaptace v rámci zákona a v rámci divadelní teorie nekorespondují tak, aby byly výklady nápomocné dramaturgům při snaze vypořádat licenční oprávnění a že původce většiny problémů během vyjednávání o licenci bývá čas (soubor začne zkoušet, aniž by divadlo mělo licenční smlouvu uzavřenou, divadlo podá žádost o licenci pozdě apod.).

Abstract:

This master´s thesis is concerned with the problematic of legal aspects of drama text editing and adaptation in theatre. The thesis is divided into three parts. The first part is compiled with the main legal regulations and legal theory. The main sources of information for the part were Copyright Act, commentaries on Czech Copyright Act and another legislation, which deals with drama text from the legal point of view. The second section deals with drama text and adaptation theory. This section is based on the technical literature. The third section consists of research into the main practical questions and specific and nonspecific practical cases. The key sources for the third part were interviews with dramaturges and communication with staff of individual theatres. The aim of this MA thesis is to describe the current legal situation in connection with the practice of theatres dealing with licences and to point out the errors, which can be prevented. I presume the Copyright Act can be understood and applied easily in usual situations, the legal and drama theory interpretations for the drama text are not corresponding the way it could help dramaturges to deal with licences and the origin of problems with licences negotiation is usually the time (ensemble begin rehearsals without the licence, theatre makes the request for the licence late etc.).
