Security detention as a new kind of protective measure in the penitentiary practice

Abstract:

Bakalářská práce se zabývá zabezpečovací detencí jako zcela novým druhem ochranného opatření společnosti od nebezpečných pachatelů trestné činnosti, kteří jsou ve většině případů vážně duševně nemocní a nebezpeční sobě nebo svému okolí a které je nezbytné po určitou dobu od společnosti izolovat. S ohledem na stoupající závažnost trestné činnosti a omezené nástroje ústavní ochranné léčby těchto pachatelů v psychiatrických nemocnicích by se v případě absence tohoto druhu ochrany společnosti od těchto osob mohlo s humanizací dnešní doby jednat o vážné ohrožení celé společnosti. Proto se v teoretické části práce věnuji vzniku, právním vymezením a podmínkám výkonu zabezpečovací detence a novým detenčním ústavům v Brně a v Opavě. Cílem praktické části práce je pak analýzou dostupných dat vymezit typického chovance detenčního ústavu, seznámit s průběhem zařazování chovanců v detenčních ústavech, terapeuticko-léčebným působením a celkovou motivací k jejich léčbě a případnému přechodu do ústavního ochranného léčení.

Abstract:

The thesis deals with preventive detention as an entirely new kind of protective measure for the society against dangerous offenders who are in most cases seriously mentally ill and are dangerous either to themselves or to those around them and who need to be isolated from the society for a certain period of time. With regard to the ever increasing severity of criminal activities and the limited tools of the constitutional protective therapy of such offenders in psychiatric hospitals, with today's humanisation in the absence of this kind of protection of the society from these persons there could be a serious threat to the whole of society. Therefore, in the theoretical part I deal with the establishment, legal definitions and conditions governing the exercise of preventive detention and the new detention facilities in Brno and Opava. The aim of the practical part of the thesis is to define through the analysis of available data a typical detention facility inmate, to introduce the process of inmate placement in the detention facilities, the therapeutic effects and the overall motivation for their treatment and the possible transition to constitutional protective therapy.
