Alternative form of financing in the Czech Republic and the EU

Abstract:

Práce poskytuje komplexní pohled na problematiku alternativních forem financování s důrazem na crowdfundování a jeho vývoj v průběhu času. V rámci historického přehledu byla analyzována evoluce crowdfundingu od raných forem do současných digitálních platforem. Důkladně byly prostudovány různé formy alternativního financování, včetně peer-to-peer půjček, business angel investorů, venture kapitálu a dalších. Rozbor rizik spojených s alternativními formami financování poskytuje komplexní pohled na možné výzvy, kterým čelí investoři a podniky při využívání těchto metod. Dále byla zdůrazněna role regulace v EU a České republice, s důrazem na směrnice MiFID II, AIFMD a směrnici o crowdfundingových platformách. Práce také zkoumá současný stav alternativního financování v České republice, včetně aktuálních trendů, regulačního rámce a přítomnosti crowdfundovacích platforem. Kromě toho je věnována pozornost novým vývojům, zejména směrnici o trzích s kryptoměnami (MiCa), a jejímu potenciálnímu dopadu na alternativní formy financování. V závěru práce jsou poskytnuty doporučení pro praxi v oblasti alternativního financování s ohledem na nové legislativní kroky a vývoj na trhu.

Abstract:

The work provides a comprehensive view of the issue of alternative forms of financing with an emphasis on crowdfunding and its development over time. As part of the historical review, the evolution of crowdfunding from early forms to current digital platforms was analyzed. Various forms of alternative financing were thoroughly studied, including peer-to-peer loans, business angel investors, venture capital and others. An analysis of the risks associated with alternative forms of financing pro-vides a comprehensive view of the possible challenges faced by investors and businesses when using these methods. Furthermore, the role of regula-tion in the EU and the Czech Republic was emphasized, with an emphasis on the MiFID II, AIFMD and crowdfunding platform directives. The thesis also examines the current state of alternative financing in the Czech Republic, including current trends, the regulatory framework and the presence of crowdfunding platforms. In addition, attention is paid to new developments, in particular the Markets in Cryptocurrency Directive (Mi-Ca), and its potential impact on alternative forms of finance. At the end of the work, recommendations are provided for practice in the field of alterna-tive financing with regard to new legislative steps and market develop-ments.
