Reproductive Rights: Selected Questions in the European Court of Human Rights decissions

Abstract:

ANOTACE Práce se zabývá problematikou reprodukčních práv žen v kontextu rozhodovací praxe Evropského soudu pro lidská práva. Hlavním cílem práce je prostřednictvím vy-braných rozhodnutí tohoto soudu zhodnotit jeho konkrétní přínos pro ochranu repro-dukčních práv žen v Evropě a zároveň zjistit, zda a jak se v těchto rozhodnutích odráží normativní představy o ženství. Pozornost je zaměřena na problematiku interrupcí, ženské obřízky a otázku adopce homosexuálními páry. Všechna rozhodnutí přitom byla vydána během posledních deseti let a vypovídají tedy o současném postoji společnosti k dotčeným reprodukčním právům. Výsledky práce ukazují, že ESLP k ochraně reprodukčních práv žen nepochybně přispívá. Ve vztahu k cílům, které si stanovují různé mezinárodní dokumenty o repro-dukčních právech, je jeho význam relativně velký, neboť v daných oblastech v určitých aspektech ochranu těchto práv posiluje. V řadě otázek je však jeho postoj velmi zdržen-livý, což je důsledkem některých přetrvávajícíh stereotypních představ, zakořeněných v současné společnosti. Počet znaků: 89 929

Abstract:

ANNOTATION This thesis deals with women’s reproduction rights in a context of the practice of the European Court for human rights (ECHR). The main goal of this paper is to evaluate its contribution to protection of women‘s reproduction rights in Europe via selected decisions of this court and to determine if and how a normative ideas of feminity are reflected in these decisions. It is focused on the problems of abortions, female genital mutilation and the matter of homosexual adoptions. All these decisions have been issued in the past ten years and represent the current position of the society regarding the affected reproduction rights. The results show that ECHR is undoubtedly beneficial to protecting women’s re-production rights. Its function with regards to the goals set by various international documents about reproduction rights is quite significant because it improves the protection of these rights in certain aspects. However, its attitude is very reserved in many questions which is a result of some remaining stereotypical ideas embedded within current society.
