Zpřístupnění spisu obhajobě ve vazebním řízení

The Access of a Defence to a File in Custody Proceedings
Abstract:
Diplomová práce se zabývá problematikou nahlížení do spisů ve vazebním řízení. Je analyzován § 65 trestního řádu. V práci je porovnáván pohled na problematiku ze strany Ústavního soudu a pohled na problematiku ze strany Evropského soudu pro lidská práva. V souladu s tím je nabídnuto srovnání dvou různých přístupů k předmětné problematice.
Abstract:
The diploma thesis addresses issue of access of a defence to a file in Custody Proceedings. It is analyzed § 65 of the Criminal Procedure Code. The work compares perspective on the issue by the Constitutional Court and the view on the issue by the European Court of Human Rights. Accordingly, it is offered a comparison of two different approaches to the issue.
