Abstract:

Cílem diplomové práce je výklad a vysvětlení okolností příprav a přijetí poválečné ústavy Československa, Ústavy 9. května, v letech 1946-1948. Práce se zaměřuje zejména na vysvětlení podstatných sporných otázek ústavy, které se řešily mezi tehdejšími politickými stranami, jež proces vzniku této ústavy provázely. Pozornost je věnována zejména sporům o postavení národních výborů, o znárodnění, o úpravě ústavněprávního vztahu Čechů a Slováků, o podobě volebního práva a v neposlední řadě postavení prezidenta republiky. Práce též ukáže, že na urychlení přijetí Ústavy 9. května měly zásadní vliv únorové události v roce 1948, neboť se v jejich důsledku prosadilo komunistické pojetí ústavy. Práce taktéž ukáže, že i když Ústava 9. května formálně zachovávala některé rysy charakteristické pro pluralitní demokracii, skutečné právní a politické poměry se od jejího znění téměř kompletně odchylovaly. Právě z těchto důvodů odmítl podepsat tuto ústavu i prezident dr. Edvard Beneš.

Abstract:

The goal of the diploma thesis is an interpretation and explanation of the circumstances of preparation and adoption of the post-war Czechoslovak constitution, the Ninth-of-May Constitution, in years 1946-1948. Specifically, he thesis focuses on explanation of the fundamental disputable questions of the constitution that accompanied the creation of its creation and that were being addressed by the then political parties. Special attention is dedicated to the disputes over a status of the national committees, nationalization, revision of the constitutional relation of the Czechs and Slovaks, a form of the election law, and last but not least role of the President of the Republic. The thesis will also show that the February 1948 events had a fundamental impact on acceleration of adoption of the Ninth-of-May Constitution, as these events influenced a communist concept of the constitution. The thesis will also prove that while the Ninth-of-May Constitution formally retained some elements characteristic for a pluralist democracy, the actual legal and political situation was almost completely different from the document. Because of these reasons president Edvard Beneš refused to sign the constitution.
