Principle of protection of weaker (party) subject and marital law
Abstract:
Cílem mé diplomové práce je analýza principů ochrany slabšího subjektu a autonomie vůle a vymezení jejich místa v manželském právu interpretací a aplikací nynějších platných právních norem, ale také v souvislosti s připravovanou rekodifikací českého občanského zákoníku. Danou problematiku jsem porovnala i se zákonnou úpravou ve slovenském právu.
Abstract:
The target of my diploma work is an analysis of principles of protection of weaker subject and autonomy of will and their placement in marital law by means of interpretation and application of actual legal rules and also in connection with the prepared re-codification of Czech civil code. The thesis I decided to compare with Slovak legislation as well.
