The Act of Bankruptcy and Composition and the Act of Insolvency in the summary of the aspects for the bankruptcy trustee's position and funkction and for the insolvency trustee

Abstract:

Diplomová práce byla vypracována s cílem porovnání vzájemného postavení, práv a povinností, ale i celkové úlohy správce konkursní podstaty v konkursních a vyrovnacích řízeních a jeho nově koncipované postavení v insolvenčním řízení (specificky pak upravení postavení insolvenčního správce v zákoně o insolvenčních správcích). Současně je rozsáhlá část práce zaměřena na postavení správce v rámci Evropské unie.

Abstract:

The aim of this thesis was working up the comparing of the mutual position, discretions and duties but also the trustee's general work in bankruptcy and composition proceedings and his newconceived position in the insolvency proceeding (specifically the adapting of the insolvency trustee's position in the law about insolvency trustees). All at once the large part of the thesis is aimed for the trustee's position in terms of European Union.
