Creditor and Debtor in the existing legislation of the Czech Republic

Abstract:

Tato bakalářská práce se zabývá postavením věřitele a dlužníka ve stávající právní úpravě ČR. V části teoretické této práce, v souladu se zadáním, se podrobněji rozebírá pojetí závazkového práva, spolu s jeho vznikem, změnou či zánikem. Závěr teoretické části pak patří možnostem zajištění pohledávky a jejího vymáhání. Cílem části praktické je pak analyzování současného stavu v konkrétní české společnosti XY s.r.o. V návaznosti na tuto analýzu jsou pak uvedeny hlavní nedostatky při vymáhání pohledávek od dlužníků a navržena možná řešení ke zlepšení jejího postavení jako věřitele.

Abstract:

The bachelor thesis deals with position of creditor and debtor in the existing legislation of the Czech Republic. In theoretical part of this work, in accordance with the specifications, is analysed in detail the whole concept of contract law, along with creation, modification and termination of claims. The conclusion of the theoretical part belongs to the possibilities of securing their claims and enforcement. The aim of the practical part is to analyse the current state of Czech firm XY, s.r.o. Following up this analysis, there are introduced the main mistakes with enforcement obligations from debtors and proposed main possible solutions to improve its position as a creditor.
