Legal aspects of use of autonomous vehicles

Abstract:

S technologickým pokrokem v oblasti umělé inteligence zavedení autonomních prvků do moderních aut se stává běžnou záležitostí, a tento intenzivní vývoj otevírá cestu příchodu automatizovaných vozidel do silničního provozu. Autonomní funkce řízení se pomalu zařazují do naší současnosti, a z tohoto důvodu je nezbytné, aby zákonodárci odpověděli zavedením regulace upravující problematiku využití automatizovaných vozidel a širokého spektra s tím souvisejících témat.Cílem této práce je shromáždit a posoudit legislativní úvahy států, ve kterých se vývoj technologií automatizovaného řízení nachází na pokročilé úrovni (v této práci konkrétně Německa a USA), a také zjistit, jaký je stav vývoje právního rámce v České republice. Nebude chybět přehled opatření přijatých na úrovni Evropské Unie. Dalším cílem je odhalit jednotlivé mezery ve stávajícím domácím právním řádu a navrhnout doporučení, která by přispěla ke vzniku komplexní úpravy otázek spojených s automatizovanými vozidly. Globálním cílem práce je posoudit, zda integrace problematiky autonomních vozidel do legislativy je skutečným krokem ve směru úplně automatizovaného silničního provozu nebo naopak překážkou pro opravdovou autonomii vozidel.

Abstract:

Nowadays there is more and more information about successful testing and deployment of self-driving cars. Thanks to the technological progress, we can reasonably expect that in the nearest future autonomous vehicles will be introduced on the public roads and will eventually become an essential part of our lives. This fact makes it necessary for the government to react by implementing the regulation of the use of self-driving cars with the broad spectrum of aspects that arise when we speak about autonomous driving.The objective of this thesis is to examine legal situation in the states known by their technological achievements in the area of development of autonomous driving systems (in particular in Germany and USA, as well as in the European Union). Another goal is to assess the current legislation regarding automated vehicles in Czech Republic, to identify the aspects that need to be regulated and to introduce some recommendations for effective and complex regulation. The general objective is to consider whether the introduction of laws regulating the aspects of autonomous driving is a step forward in deployment of fully automated vehicles or on the contrary a limitation for autonomous driving.
