Euthanasia - legal and ethical aspects of protection of human life in its terminal stage

Abstract:

Úkolem práce je seznámení s pojmy eutanázie, s historií eutanázie, zejména vývojem vztahu k umírajícím a trpícím. Zdůrazněno je zneužití eutanázie v době nacistického Německa, dále jsou popsány jednotlivé formy eutanázie – aktivní, asistovaná sebevražda, pasivní eutanázie, ale i opak eutanázie – dystanázie. V práci se upozorňuje na nebezpečí počínající komercionalizace eutanázie – kliniky ve Švýcarsku, výjezdové týmy v Nizozemí apod. V práci je položen důraz na jedinou možnou a z pohledu autora správnou alternativu eutanázie, a tou je péče o umírající, kterou se zabývá paliativní medicína. Jedná se zejména o hospicovou ambulantní a lůžkovou péči. V textu je dále vysvětlen pojem bolesti, léčba bolesti, kterou řeší ambulance bolesti zřizované při zdravotnických zařízeních. Práce popisuje formy eutanázie ve vybraných zemích, a to včetně právní úpravy. V dané práci je také proveden rozbor právního názoru (stavu) na eutanázii v České republice, kde žádná z forem eutanázie není povolena. Jak už z názvu práce vyplývá („právní a etické aspekty terminální fáze lidského života“) dalším aspektem zkoumání je etický pohled. Etika je v práci popsána jak z obecného hlediska, tak i z pohledu jejího vztahu k eutanázii. Součástí etického pohledu je i vztah pacienta a lékaře.

Abstract:

The objective of the thesis is familiarization with the terminology and history of euthanasia, particularly with the development of the attitude to the dying and suffering people. The thesis points out at the abuse of euthanasia in the era of Nazi Germany, and describes various forms of euthanasia – active euthanasia, assisted suicide and passive euthanasia as well as dysthanasia, which is the opposite of euthanasia. The thesis draws attention to the hazards of the commering commercialization of euthanasia – clinics in the Switzerland, travelling teams in the Netherlands, etc. The thesis lays emphasis on the only possible and correct alternative to euthanasia, as seen by the author, namely the care of dying people that is addressed by palliative medicine. It is particularly outpatient and inpatient care in hospices. The text also contains explanation of the term pain and pain treatment provided by pain treatment surgeries established in healthcare institutions. The thesis describes the forms of euthanasia in selected countries and their legal regulation. The thesis also analyses the legal opinion (situation) concerning euthanasia in the Czech Republic where none of the forms of euthanasia is permitted. As it follows from the title of the thesis (“Legal and Ethic Aspects of the Terminal Stage of a Human Life”), another aspect of the research is the ethical view. The thesis describes ethics both in general terms and in terms of its relation to euthanasia. The ethical view also includes the relation between the patient and the physician.
