Abstract:

Má diplomová práce se soustřeďuje na problematiku mezinárodní subjektivity státu, jeho uznávání a přijímání do mezinárodního společenství. A to na případové studii Bosny a Hercegoviny v polovině devadesátých let minulého století. Hypotézou práce je přesvědčení, že v případě Bosny vznikl sice demokratický stát, ovšem s omezenou vnitřní suverenitou a limitovanou mezinárodní subjektivitou. První část práce přibližuje teoretické koncepty a instituty mezinárodního práva a mezinárodní praxe, které jsou při vzniku státu a nabývání suverenity aplikovány a užívány. Druhá část stručně vykresluje válečné konflikty, které na území Bosny a Hercegoviny po jejím osamostatnění od socialistické Jugoslávie vypukly. Další části se již konkrétně věnují bosenské realitě a faktické poznatky komparují s teoretickými premisami. Souběžným předmětem zájmu mé práce jsou nová pravidla pro uznávání států vylsovená ES. Závěr práce potvrzuje vyslovenou hypotézu vztahující se na mezinárodněprávní statut Bosny a Hercegoviny a také hodnotí nová evropská pravidla uznávání států jako neadekvatní alternatiovu těm tradičním.

Abstract:

My graduation thesis concentrates on a case of Bosnia and Herzegovina. - a big lesson for the international community and international forces which are involved in democratic/humanitarian interventions, peacekeeping and state-building. The core subject of my thesis is a Bosnian sovereignty and its statehood. For the recognition of the post-Yugoslav republics were used new European rules introduced by the EC Guidelines on Recognition of States. Besides the traditional claims on a territory, population and an effective government, the EC required acceptance of human rights conventions, obligations from non-proliferation and arms limitation conventions and especially a nonstandard application procedure. The first part of my paper handles with the theory of statehood, sovereignty, subjects of international law and recognition of states. Next part draws near violent conflicts in the Bosnian territory. The other parts focus on the real situation in Bosnia and Herzegovina after the cease-fires and Dayton Peace Agreements which settled the new constitutional and political regime in this country. The Bosnian reality is compared with the theoretical aims held by the international supervisors of the Bosnian transition. My hypothesis is pointed at the conviction that the Bosnia is a real state but a limited democracy, a state with limited statehood. The international institutions (substituting attributes of the states) and their representatives concentrate wide competences and huge power in their hands. Their mandates have splayed out in the course of time, and the legislature and executive branch are run without an adequate legitimacy and suitability. Finally, the new set rules on recognition of states suffer from inconsistency and are not fitting alternative for international practice.
