Insane offender

Abstract:

The rigorous thesis deals with legal institute – insanity of offender. The insanity is in this work taken from juristic point of view although there is also used knowledge from forensic psychiatry and psychology. Thesis distinguishes self-induced insanity and non-induced insanity and deals with each of them separately. The rigorous thesis primarily focuses on analysis of legislation of insanity de lege lata. Alongside with that we have to mark specifics of legislation of insanity of juvenile offenders. Thesis includes also a brief historical excursus describing development of legislation of insanity. In the chapter about self-induced insanity the rigorous thesis deals with the crime of drunkenness and the legal institute actio libera in causa. At the end of thesis, there is also a chapter about mental state examinations of the prosecuted and a chapter devoted to issues of insanity simulation.

Abstract:

Rigorózna práca sa zaoberá právnym inštitútom nepríčetnosti páchateľa. Na nepríčetnosť je v práci nahliadané najmä z juristického hľadiska, pri výklade sú však využívané aj poznatky z oblasti forenznej psychiatrie a psychológie. Práca rozlišuje zavinenú nepríčetnosť a nezavinenú nepríčetnosť a pojednáva o nich samostatne. Ťažiskom práce je rozbor právnej úpravy de lege lata, pričom poukazuje aj na zvláštnosti právnej úpravy nepríčetnosti u mladistvých páchateľov. Práca ponúka tiež historický exkurz vývoja právnej úpravy nepríčetnosti. Samostatná kapitola je venovaná zmenšenej príčetnosti. V rámci kapitoly o zavinenej nepríčetnosti pojednáva o trestnom čine opilstva a inštitúte actio libera in causa. Na záver práce je zaradená kapitola o vyšetrení duševného stavu obvineného a kapitola venovaná problematike simulovania nepríčetnosti.
