Status of Debtor and Creditor in Preventive Restructuring Proceedings under Czech and Austrian Law

Anotace:

Tato diplomová práce se věnuje problematice preventivní restrukturalizace, která vychází ze směrnice o preventivní restrukturalizaci, a jež byla následně implementována v právních řádech České republiky a Rakouska. V práci je prvně analyzována preventivní restrukturalizace v širším kontextu s ohledem na vývoj insolvenčního práva v Evropské unii a v národních právních řádech. Následně je pak detailněji analyzováno postavení dlužníka a věřitele v procesu preventivní restrukturalizace, a to jak z hlediska jejich práv a povinností, tak i podmínek, které musí tyto subjekty splnit. Cílem práce, po provedené komparaci a analýze, je identifikace klíčových rozdílů v postavení dlužníka a věřitele a jejich praktických důsledků, a dále posouzení souladu právních úprav s cíli a požadavky stanovenými směrnicí o preventivní restrukturalizaci.

Abstract:

This diploma thesis deals with the issue of preventive restructuring, which is based on the Directive on preventive restructuring, and which has been consequently implemented in the legal systems of the Czech Republic and Austria. The thesis is the first to analyse preventive restructuring in a broader context with regard to the development of insolvency law in the European Union and in national jurisdictions. Subsequently, the position of the debtor and the creditor in the pro-cess of preventive restructuring is analysed in more detail, both in terms of rights and obligations, as well as the conditions to be fulfilled by these entities. The aim of the thesis, after comparison and analysis, is to identify the key differences in the position of the debtor and the creditor and their practical consequences, as well as to assess the compliance of the legal regulations with the objectives and require-ments set by the Directive on preventive restructuring.
