Consumer Protection in the Arbitration

Abstract:

Diplomová práce „Ochrana spotřebitele v rozhodčím řízení“ se zabývá kritickou analýzou právní úpravy zákona č. 216/1994 Sb., o rozhodčím řízení a výkonu rozhodčích nálezů. Práce reaguje na změny související s ochranou spotřebitele, které byly přijaty Novelou č. 19/2012. Práce nejprve pojednává o historickém exkurzu a následně rozebírá východiska Novely. Dále jsou rozebírány předpoklady rozhodčího řízení a povinné náležitosti rozhodčí doložky uzavřené spotřebitelem. Práce také vymezuje obecná kritéria osoby rozhodce, který řeší spory ze spotřebitelských smluv. Další kapitoly pojednávají o ochraně spotřebitele v průběhu a po skončení rozhodčího řízení. Součástí práce je vlastní hodnocení právní úpravy a návrhy de lege ferenda.

Abstract:

The thesis “Consumer Protection in the Arbitration“ deals with a critical analysis of a legal regulation of the Act No. 216/1994 Coll., on Arbitration and Enforcement of Arbitral awards. The thesis responds to changes related to a consumer protection, which were adopted by the amendment No 19/2012. At first, the thesis mentions a historical context and subsequently develops starting points of the amendment. Further, there are analysed assumptions of arbitration and mandatory requirements of an arbitration agreement concluded by a consumer. The thesis also defines general criteria for the office arbitrator who resolves disputes arising from a consumer contract. Other chapters follow up the consumer protection during and after the arbitration. The thesis includes a self-evaluation of the legal regulation and modification proposals de lege ferenda.
