Cílem této práce je analýza institutu odstoupení se zaměřením na otázku, které účinky odstoupením od smlouvy za současně platné občanskoprávní úpravy zanikají. Otázkou je, zda se v důsledku odstoupení zrušují pouze obligačně právní účinky smlouvy, nebo zda dochází se zrušením obligačně právních účinků zároveň ke zrušení věcně právních účinků smlouvy. The subject of this thesis is a detailed analysis of a regulation of an avoidance of a contract in the Czech Civil Code. The question is if only effects in personam are reversed after the valid avoidance of the contract or if effects in rem are also nullified by the valid avoidance of the contract.
