Disputability Notes under the Cadastral Act

Abstract:

Cílem diplomové práce je reflexe právní úpravy tzv. poznámek spornosti v zákoně č. 256/2013 Sb., o katastru nemovitostí (katastrální zákon), ve znění pozdějších předpisů. Práce by měla nejprve osvětlit obecnou podstatu poznámky jako správního úkonu katastrálního úřadu a dále zásadu materiální publicity a její spojitost s problematikou poznámek spornosti. Ve svém jádru by práce měla identifikovat a analyzovat jednotlivé poznámky spornosti upravené katastrálním zákonem a také zhodnotit jejich právní úpravu jednak ve vztahu k dříve účinné právní úpravě a jednat k "obecné" úpravě v občanském zákoníku. Práce by vyjma aktuální judikatury měla zohledňovat také (autorce známou) aplikační praxi. Výsledkem práce by mělo být zejména kritické zhodnocení, zda je úprava poznámek spornosti v katastrálním zákoně vyhovující, resp. zda by měla být nějak změněna.

Abstract:

The aim the diploma thesis is to reflect the legal regulation of the socalled disputability notes in Act No. 256/2013 Coll., on the Cadastre of Real Estate (the Cadastral Act), as amended. The thesis should first explain the general nature of the notes as an administrative act of the cadastral office and furhermore the principle of material publicity and its connection with the issue of disputability notes. At its core, the thesis shoudl identify and analyses the individual disputability notes regulated by the Cadastral Act and evaluate their legal regulation in relation to the previously effective legislation and the "general" regulation in the Civil Code. In addition to the current case law, the work should also consider the application (known to the author). In particular, the thesis should result in a critical assessment of whether the regulation of the disputability notes in the Cadastral Act is satisfactory or whether it should be changed.
